Ungaro calls Special Meeting to order.
Mrs. Wollet leads the Pledge of Allegiance.
Mr. Scharville calls roll call. Ungaro, Wollet, and Kempers were present.
Zoning Inspector, Robert Monus, presents proposals of Zone Change Case number ZC-01-19, Amendments to the Zoning Resolution. There are 3 sections of language being amended. He states all previous meetings have been held and all notifications of public hearings have been advertised and the Zoning Commission approves all the proposed changes, and has made a recommendation to forward the case to the Township Trustees for their Action.
All items listed below that are underlined are to be added or incorporated into the Sections listed below.
The proposed changes are as follows:
Monus presents proposal of a recommendation for Section 7.14. Fences and Walls. Item 3. A fence, wall, or fence post located between the street right-of-way line and the minimum building setback line shall not exceed a height of four feet (4’). In addition to that, Item 5. of the same section shall read: On a corner lot, a fence, wall, or fence post shall not be located closer than twenty feet (20’) from any right-of-way line.
Monus presents changes for Section 2.02 Definitions, Miscellaneous Material. To incorporate, Is a violation of the zoning code to have junk, garbage, and rubbish whether screened from view or not that may result in a public/private nuisance. Also to add the word Any and or the exterior not being used for its intended or designed purpose as related to incorporated into the second sentence of the same definition. The words deteriorating accessory/outbuilding will be incorporated to the last sentence of this definition. This same section will also add new two new Nuisance definitions to read as follows:
Private Nuisance: involves the disturbance of land that results in an unreasonable interference with the use and enjoyment of the property that may be detrimental to the public health, safety and morals.
Public Nuisance: involves the disturbance of land that results in an unreasonable interference with the use and enjoyment of property that has a broader effect on the interests of the public in general that may be detrimental to the public health, safety and morals.
Monus presents changes for Section 8.02 Agriculture Permitted in Any District Agriculture permitted in any District to incorporate as prescribed by Ohio Revised code, Section 519.21 (b). and also to add, Certification affidavit is required by Mahoning County Building Inspection Department and Poland Township Zoning Office.
Ungaro motions to adopt case number ZC-01-19. Seconded by Wollet. Voting yes- Ungaro, Wollet and Kempers. Motion carried.
Ungaro motions to adjourn from the special meeting zone changes at 5:40p.m. Seconded by Wollet. Voting yes- Ungaro, Wollet and Kempers. Motion carried.
